Terms of Service

1. Agreement to these terms

By accessing or using the Peak platform (the “Service”) you agree to be bound by these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it. If you do not agree, do not use the Service.

2. What the Service is

Peak is a multi-tenant WhatsApp Business messaging platform. It lets businesses connect their own WhatsApp Business Accounts, hold customer conversations on a shared desk, send approved message formats to an audience, and automate replies — all through Meta's WhatsApp Business Cloud API. Your use is also subject to Meta's WhatsApp Business Terms of Service and its applicable policies.

You connect your own WhatsApp Business Account. Your number, your quality rating and your verification status remain yours.

3. Your account

You need an account to use the Service. You agree to:

  • Give accurate, current and complete registration information
  • Keep your password secure and not share it
  • Tell us promptly about any unauthorised use of your account
  • Take responsibility for everything done under your account, including by teammates you invite

We may suspend or close accounts that give false information or breach these Terms.

4. Acceptable use

You agree not to use the Service to:

  • Send unsolicited messages, or message anyone who has not opted in
  • Breach Meta’s WhatsApp Business Policy, Messaging Policy or Commerce Policy
  • Distribute illegal, harmful, defamatory or fraudulent content
  • Impersonate any person or organisation
  • Attempt to gain unauthorised access to the Service or its infrastructure
  • Scrape or automate access to the platform outside our documented API
  • Do anything that disrupts or degrades the Service for others

5. Messaging compliance is yours

You are solely responsible for making sure every message you send through Peak complies with the law that applies to you — including anti-spam and data-protection law — and with Meta's policies. You must hold valid opt-in consent before sending marketing messages. Peak is not liable for the messages you choose to send, or for any regulatory or Meta policy consequence arising from them.

Meta may restrict, suspend or ban a WhatsApp Business Account for policy breaches. That decision is Meta's, not ours, and we cannot reverse it on your behalf.

6. Plans, credits and payment

Paid plans are prepaid and include a credit allowance for messages and AI features. Credits are consumed as you use the Service and can be topped up at any time. Conversation charges set by Meta are passed through and are outside our control.

Fees are non-refundable except where required by law. If your plan lapses or your credit balance reaches zero, sending is paused until you renew or top up; your data remains available to you.

7. Intellectual property

The Peak platform — its design, code, trademarks and content — belongs to us and is protected by intellectual-property law. You get a limited, non-exclusive, non-transferable licence to use the Service for your own business purposes. You may not copy, modify, distribute or create derivative works from it without our written consent.

Your data stays yours. Your contacts, conversations and message formats belong to you, and we claim no ownership over them.

8. Data and privacy

Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms. In short: for your account data we are the controller, and for the contact and message data you process through the Service we are a processor acting on your instructions.

9. Availability

We work to keep the Service available, but we do not promise uninterrupted access. We may need to suspend it for maintenance, and parts of it depend on Meta's infrastructure, which is outside our control.

10. Limitation of liability

To the maximum extent the law allows, Peak and its affiliates, officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages — including lost profits, lost data or lost goodwill — arising from your use of, or inability to use, the Service. Our total liability to you will not exceed the amount you paid us in the twelve months before the claim.

11. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, error-free, or free of harmful components.

12. Indemnification

You agree to indemnify and hold harmless Peak and its affiliates from any claim, liability, damage, loss or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your breach of anyone else's rights, including Meta's policies.

13. Termination

We may suspend or end your access at any time for conduct that breaches these Terms or that we judge harmful to other users, to us, or to third parties. On termination your right to use the Service stops immediately. You may export your data for 30 days afterwards. Clauses that by their nature should survive — liability limits and indemnities among them — continue to apply.

You may close your account at any time from your account settings.

14. Changes to these terms

We may change these Terms. We will post the updated version here with a new “Last updated” date, and we will notify you in the app of material changes. Continuing to use the Service after a change means you accept it.

15. Governing law

These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising under them.
